In this it states that in Nov. of 1851, Dolphus Duckett and a number of relatives, including Elijah Ferguson, his brother in law, John Duckett, his brother, also Daniel Weaver, Slight England, Alfonso England, Eli Riley, Rev. William Devors, William Shockley, his partner in the mining venture, Tom Stringen, and others, embarked on the steamship Isabella at Savannah, Ga., landing at Havana, Cuba three days after the rebellion in which Narciso Lopez led his insurection and met his death. GA-50 They stopped for repairs and water, but could not go ashore until the ship was searched for weapons and other implements of war. When they were allowed to go ashore they could have no arms, not even a pen knife. All the natives were armed with sword or machete, and would use these implements to tip the hat of anyone in reach, then draw the blade across the neck of each, telling them if they as much as moved they would cut their head off. From Cuba they sailed to Panama and crossed the Isthmus there. An account of them going up the river in a boat is mentioned, this of course was the Chagres River, and those who crossed the isthmus did boat up this river until it was no longer navigable, then they walked the remainder of the way. It seems they were accosted by natives in a boat coming down the river, but when they brandished pistols, the natives seeing they were out gunned veered off, and they continued their voyage. There are the miners ten commandments that are included in this but I have omitted these. In the Duckett History by Gresham Duckett, it does state that Jacob Duckett and Amy Hipps migrated in 1823 from Buncombe Co., NC to Habersham Co., now White Co., Ga. He purchased a farm at the foot of Skits Mountain on Mossy Creek. We find my father, Dolphus Duckett at the age of 16, working with a construction crew on the Georgia State Railroad near Atlanta, Georgia, as a cart driver in order to pay a security debt obligated on a promissory note by his father, Jacob Duckett. Gresham states that after all his expenses for his mining adventure his father had two thousand dollars in gold and several hundred in silver. He brought this gold dust back in what was known as a gold dust jacket, which was worn beneath the shirt. He returned to Ga, in August of 1854. The farm he bought on Yahoola Creek, near Dahlonega, in Lumpkin Co., Ga. was sold in May 1868, and he bought a farm at Hollingsworth, Banks Co., Ga. This plantation consisted of nine hundred and sixty acres. Gresham Duckett now owns the old home place, it is bounded on the west by the Hudson River, and the Mountain Creek flows through the center of the farm. Elijah and Seaborn, sons of Dolphus Duckett, own the balance of this property. During the Confederate War Dolphus Duckett served with the State Troops under Governor Joseph E. Brown. He was commissioned as a first Leutenant and served from January 1862. He was discharged from the regular army as a private. The Georgia State Railroad being short of fuel for wood burning engines, he with two other soldiers, and his neighbors at the time, William Gerrin and John Abercrombie, volunteered to chop wood for ten months, serving as though they were in camp. Here again we see our father chopping wood for the same railroad he helped to construct when he was a lad of 16. GA-53 The last year of the war records show that he was released from his Army service in camp, and was sent home to serve as blacksmith for the wives and widows of the soldiers in his home section. Not being a professional blacksmith he received no pay for this, he was to work free of charge, receiving the same allowances as if he were at camp, and subject to recall. It appears that Dolphus journeyed overland on his return frpm Calif., this as he stated he had been in 13 states, Indian Territory, Cuba and Panama. This would infer that he came back through the Indian Territory of Okla. on his return. On 26 April 1905, John Duckett of Raleigh, NC, wrote a letter in response to an earlier letter written him by a Dr. P.Y. Duckett of Wichita Falls, Tex. After examination of this and other data shown in this book, this Dr. P.Y. Duckett has to be Pierce Young Duckett, born 29 May 1862, son of Dolphus Duckett and Sarah Ferguson. See the foregoing history by Gresham Duckett, brother to this Pierce Young Duckett. What is of great interest in this is that this John Duckett did have some knowledge as to the family of Dolphus and Sarah Duckett, and in this letter he states that Dolphus Duckett married Sarah Ferguson, she a dau. of Major Ferguson. The fact that he refers to Hugh Ferguson as Major Ferguson is significant in that it supports the Lawrence Co., Mo. History, this found in the Mo. section of this book. In this history, subject of same being Lewis C. Ferguson son of Hugh Ferguson and his second wife Mary A. Garrin, Lewis C. states that his father was commonly known as Major Ferguson. Lewis C. Ferguson names Champ, Edward, James, John, Andrew, Belfield, Elijah and Elizabeth, who married Lewis Wright, as siblings to his father. While William and Juda (Wood) Ferguson did have the named children, they also had a son Henry Wood, a son William, a son Ellis, and a dau. who married a Davis, she the mother of James S. Davis who is named by Juda (Wood) Ferguson as a grandson, this in her pension data. The problem with this history is that Lewis C. Ferguson gives Henry as the name of his father, and while he gives William Ferguson as his grandfather, he shows Mae A. Wood as the wife of this William Ferguson, and we know her name to have been Juda Wood, a dau. of Belfield Wood. In some other data I have, this showing no documentation however, it shows M.A. as a dau. of William Ferguson and Juda Wood. Information obtained from Johna Goade,a descendant of Lewis C. Ferguson, said information obtained after the foregoing and following was written shows that a son of Lewis C. Ferguson was the informant for the History of Lawrence Co., Mo. GA-54 If we review the data we have on this Lewis C. Ferguson, I think we can make at least some educated guesses as to why some errors and omissions occur in this history. First note that this Lewis C. Ferguson was born in 1849, and that his father Hugh Ferguson died in 1862, Lewis C. being no more than 13 years of age at this time. Note also that Hugh Ferguson, father of this Lewis C., was commonly known as Major Ferguson. I think with this we can see that in probability Lewis C. had never heard his father addressed by his given name, being addressed as either father, papa etc., or Major. I think much the same would have applied to his grandmother Juda (Wood) Ferguson, knowing her as Granny etc. We do see that this Lewis C. Ferguson did know something of the family of William and Juda (Wood) Ferguson, this as he correctly names eight of the thirteen of their children, this providing one allows Champa to have been Champion, and Belfine to have been Belfield. We also note that all of those not named by Lewis C. Ferguson had died prior to 1850, this save William, who is in the 1860 census of Sebastian Co., Ark. In the foregoing records written by Gresham Duckett we find the data given to fit with census reports, recorded marriages, and other records of a documentary nature. We also see that Gresham and others mentioned were in a position to have accurate information, this as by his recordings we see that Gresham's mother Sarah resided with him following the death of her husband Dolphus, so Gresham would certainly have been privy to any family information possessed by his mother Sarah. We also note that Sarah was born in 1820 and married in 1844, and also note by the 1840 census of Habersham Co., Ga., also by the age of children of Hugh Ferguson and his first wife, that Mary Ann (Higgins) Ferguson lived until sometime in the 1840's, thus assuring us that Sarah knew her mother, and therefore would have been given the family information from her. We also see in the 1850 census of Habersham Co., Ga. that Dolphus and Sarah Duckett were residing next door to Juda Ferguson, this the widow of William Ferguson. I have a copy of the works of Mrs. Lester Lane. In this is a great deal that was taken from the records kept by Gresham Duckett, and you will see most of this in the foregoing. I have abstracted in places, but left all things of a genealogical nature intact. Letters written In 1939 by a Josephine Moore Staton of Clermont, Ga., are a part of this genealogical study, however there are some things we see in these that can be proven in error. Josephine Moore was a dau. of Milton Moore and Mary Ann Ferguson, she a dau. of Hugh Ferguson and Mary Ann Higgins. Josephine Moore married Tom Staton, and they had children Guy, Mollie and Ferd, according to a niece of this Josephine (Moore) Staton. GA-55 In the letter written by Josephine Moore Staton it states. Our great grandfather was William or Billie Ferguson, who married Judy Wood. She names as children of William and Juda, Henry, Edward, Louis, Elijah, Ellis, Champion, Ely, Riley, Elizabeth and Andrew. Three of these are in error, these Louis, Riley and Ely. Riley Ferguson was a son of James Hamilton Ferguson, who is omitted as a son of William and Juda, John is also omitted, as is William H. Ferguson, and of course Hugh Ferguson is omitted in this, and that is a puzzle as to why. She does state that William Ferguson had 11 sons, and that is true. The niece to Josephine Staton was Myrtle, a grand dau. of Kimsey Staton who had a dau. Zora, who was Myrtle's mother. Kimsey Staton was a brother to Tom Staton. Kimsey Staton is reported to have married a Ferguson, but they don't know how or if she was related to Hugh Ferguson, they can't recall her given name. This information from Mrs. Willette Dalton, grand dau. of Gresham Duckett. See Kimsey Staton mentioned in the chronicles of Horatio Hennion. This is the first time outside my own research that I have found Henry, whose full name was Henry Wood Ferguson, and also Ellis Ferguson, listed as sons of William and Juda, and we can show them to have been sons. In addition there was a dau. who married a Davis. This dau. can be seen in the 1810 census of SC, as well as the 1820 Ky. census, and she is also indicated in the pension deposition of Juda (Wood) Ferguson, where she names a J.S. Davis as a grandson. In another letter written by Josephine Staton, same year and city, it starts with: My dear cousins, Mary and Alice. (Mary is Mary Cash, who married Lester Lane; Alice is Missouri Alice, dau. of Dolphus Duckett and Sarah Ferguson, this Missouri Alice married Albert Cash, half brother to Mary Cash. Mary Cash was raised by Albert and Missouri Alice Cash). In this letter she refers to Young having lost an eye. Here she must be referring to Young Duckett, son of Gresham Duckett, although I have never heard about this Young Duckett losing an eye. she also states that she had a letter from Mark, saying that Ruth was married on the 26th, and as the letter is dated 3/9/1939, this must have been the 26th of Aug 1939. She also says in this letter that Mark wrote that uncle Tom Allen was in bad shape, and says she feels sorry for Nellie, who was apparently Tom Allen's wife. she then tells what she knows about the Duckett's, and says the old folks were Jacob and Amy (Hipps) Duckett. She states she knew of 5 boys and three girls, and states she never knew of the one they had mentioned, this Sarah Glaspy. She writes, Joe Sirah, who married ________ Higgins, was our mothers first cousin; David married Sarah Elliet (Elliott); Hamilton, I never knew who he married. (This was Alfred Hamilton Duckett, who married Malinda Brock), Dolphus, you know who he married. The girls were, Rachel, she married uncle Champ Ferguson, our grandfathers brother, Fine married Riley Ferguson, our mothers first cousin. GA-56 She states that Rachel went to Ark., and that Fine went west. (When she refers to Fine she refers to Josephine Duckett, who married Riley H. Ferguson, son of James Hamilton Ferguson, I imagine this should have been spelled Phine, and was a nickname for Josephine. She also mentions Thietho, who married Carey Cox, and we know that Talitha Duckett married Carey Cox). She also states that Ab Cox was the father. (Riley Ferguson remarried and removed to Ala. After 1870, Josephine died before 1870, see the 1870 Hall Co., Ga. census, home of Riley H. Ferguson. We of course know that Rachel (Duckett) Ferguson did indeed go to Ark. See Fulton Co., Ark.) The father of Carey Cox was William Cox, not Ab Cox. I do not know of a Joe Sirah Duckett, son of Jacob and Amy Duckett, and think this may be John Duckett, who married C. Sarah Higgins in Habersham Co., Ga. This of course would be that John Duckett who went to the Calif. Gold Field with his brother Dolphus Duckett. We also see this John Duckett as co-admn. for the estate of Alfred Hamilton Duckett, this in 1860. If this be true, then by this letter it would indicate that C. Sarah Higgins was a sister to the Mary Ann Higgins who married Hugh Ferguson, and as Josephine Staton in this letter refers to Riley H. Ferguson as our mothers first cousin, her mother would have to be related to the line of William and Juda (Wood) Ferguson in some way. Willette Dalton informs me that Josephine (Moore) Staton was a dau. of Milton Moore and Mary Ann Ferguson, Mary Ann a dau. of Hugh Ferguson and his first wife, Mary Ann Higgins. Another option is that (Joe Sirah) is Josiah, who married Nancy Ferguson, dau. of Hugh Ferguson. Additional information gained after writing the foregoing, shows that Sarah, w/o John Duckett, was a d/o John J. Higgins, also data indicates that Jane, w/o Thomas Brock Sr., Mary Ann, w/o Hugh Ferguson, and John J. Higgins, were brother and sisters. In the 1860 Hall Co., Ga. census we see an F. Staton, age 67, born Va., and a wife Nancy, age 69, born SC. In this home is Mary Ferguson, age 54, born Ky. This is the wife of James Hamilton Ferguson, and the mother of Riley H. Ferguson. In 1870, Hall Co., Ga. she is seen in the home of Riley H. Ferguson, and in 1880 she is in the home of her son, John C. Ferguson, this in the Clinton Co., Ky. census of that year. This Mary Campbell Ferguson died and is buried at Bells, Grayson Co., Tex. From the foregoing letter by Joe or Josephine (Moore) Staton, and the relationship of this Joe/Josephine Staton, we can see that Riley H. Ferguson was her mothers first cousin, this as her mother was Mary Ann (Ferguson) Moore, who was a dau. of Hugh Ferguson, and James Hamilton Ferguson was a brother to Hugh Ferguson and the father of Riley H. Ferguson. GA-57 Horatio Hennion wrote about leaving his birth state of New Jersey and of touring part of the country before arriving at Mossy Creek, Ga. in 1853. The following are excerpts from his chronicles. as well as data taken from notes made by the future wife of Horatio Hennion, this Margaret Jane Service. The data from these notes was compiled and printed by his dau., Alice Dixon in 1900. An Acrostic written by Horatio Hennion, and given to Margaret Jane Service on May 25th, 1854. Read the first letters downward. Many have sung of beauty bright, And talked of love from morn till night, Read, sung, and told their story, Given up their body, soul and mind, And wished for one of woman kind, Ruby lips to them were glory, Every one should e'er complain, Til they have alas; loved in vain. Jerusalem; what makes me hate, And sigh and pine for cruel fate? Not many die from broken hearts, Each one can leave for other parts: So when there's one you want to marry, E'en ask her; don't you stop to tarry, Refusing can not hurt you long, Verily there are others, old and young, In other places ever ready, Couldn't say no to anybody! Everyone then, should not cry, when their refused when e'er they try. The records written by Horatio Hennion and Margaret Jane (Service) Hennion, while not exact duplicates, both show much the same as far as Habersham and White Co's., Ga. are concerned, so I will work mostly from what was written by Margaret Jane (Service) Hennion. Horatio Hennion married Margaret Jane Service at Mossy Creek, Ga. on 29 July, 1855. Near the conclusion of Horatio Hennion's accounts he gives some relationships, these are as follows: Note: Major Hugh Ferguson lived up the creek. He had brothers Ed, Andy and Champion. They were of Revolutionary stock from Ky., and all had good fighting qualities. In the early part of the war Ed (a lawyer) moved to Kentucky. He and his home guards sent word to a secesh that they would fight them fairly. The secesh got some friends and fired on them. Ed's men retreated in the end; but Ed fought till he was shot to pieces. In the foregoing paragraph Horatio is writing about Edward Ferguson, who married Selina Duckett. Edward was next to the youngest child of William Ferguson and Juda Wood. Edward is buried in a cemetery in Clinton Co., Ky., see Ky. cemeteries in this book for him. GA-58 When Horatio writes about Major Hugh Ferguson, he is writing about the father of William J., John H., and Hugh Hamilton Ferguson. Of course Hugh did not reside in Ky., but the others Horatio mentioned did. Where Horatio writes about the Secesh, he is writing about the Secessionists, or Confederates. Ed Ferguson sold to Horatio Hennion and Hamilton Ferguson (brother in law to H.H.'s wife), a tract of 250 acres in the gold regions, in the year 1855. H. Ferguson and H. Hennion made a deed out for half to a man by name of Higgins, and then Ham quit claimed the remainder to Horatio Hennion. Major Hugh Ferguson lived up Mossy Creek. He was the father of Hamilton, Lewis, Betty ______, ________, and Bill. (He actually omits five more, these Vanetta and Samantha, who along with Lewis C. Ferguson were children of Hugh and his second wife Mary A. Garrin). The others were Nancy, Sarah, John H., Elijah and Mary Ann. Andy lived down Mossy Creek, father of Jack, Jim etc. (Andy is Andrew J. Ferguson, youngest child of William Ferguson and Juda Wood. L.L.D.) Champion Ferguson, John, Jim, Messer, Jake, Anthony, Bill. (This is in reference to some of the children of Champion, all are not named here, see my book.) Ed Ferguson at Ironworks, father of Wayne. (This is in reference to an iron forge run for a time by Horatio Hennion, they made iron but quit because the ore was too far away. Wayne is in reference to one of Edward Ferguson's son's.) On 30 May 1900, Littleton, New Jersey, Alice (Hennion) Dixon, dau. of Horatio Hennion and Margaret Jane Service, copied from her mothers notes, and that is as follows: It was 3 April when I was ushered into this world at London Creek, SC, and it seemed to grow larger all the time. She tells about the various trees and other plants in SC, and she writes about spinning and weaving, and says her sister Eliza would weave their dresses. She writes about making quilts, and says filling quilts fell to her lot, but she would rather care for the chickens, geese, turkeys and peafowl, and to weave. She states that her mother made fly brushes from the feathers of the peacocks, they were used to brush flies away from the table, and would sell these at Coopersville for 50 cents each. The Broad River was about a mile and a half away, and Coopersville was built on it. We used to cross over it in a flat boat to go to church after the bridge was swept away by a flood. She says her father was a stone and brick mason, and that he died when she was about nine years of age. We raised lots of cotton on the farm, also hogs and sheep, and spun the wool from the sheep. My brother James died about two years before father did, and not a great while after that our house was burned to the ground. She mentions a young slave named Joe, and said that Mary Ellen went away and told her to stay, but she went to Uncle Robert's, but before leaving she put a board on the fire (they apparently had a fire built outside), and told the slave Joe not to let it go out. GA-59 She then says that when she started for home from uncle Robert's that a cousin walked part way with her, and when she arrived at the gate she saw the house afire and ran back to her uncles, but he could only salvage a few things. Apparently the negro slave had let the fire become to large and sparks had ignited the house. That broke up our home and changed things around considerably. We went to live with my brother Thomas, who was married to Sarah McKown, (think that should be spelled McCown. L.L.D.), but I didn't like that much. In 1853 my sister Eliza, who lived in Georgia, sent for mother and myself to come and live with her, as her husband James Gilmer (this is followed by Andrew, Andy, Gilmer in parenthesis L.L.D.) had the gold fever and had gone to California to make his fortune and never returned, leaving her with 4 children to struggle with. Ma and I got ready and in the fall William Ferguson came for us and I bid farewell to my native home for 21 years. She states that she went back to visit a few months before her mother died, but it looked so desolate and deserted. So many had gone to war and never returned. (Mary Ellen at this time was already in Ga., perhaps going to her sister Eliza's earlier. I say this as Hugh H. Ferguson married Mary Ellen on 3 April 1853. Also the William Ferguson she refers to has to be none other than William Jasper Ferguson, elder brother to John H. and Hugh Hamilton Ferguson, and my great grandfather, this as no other Ferguson in that area of Georgia fits the required parameters. I have no idea as to why William J. Ferguson and not his brother Hugh H. Ferguson, went to SC to pick them up.) When we moved to Georgia we moved in a covered wagon. We started from the summer house out of Coopersville. We passed through Limestone Springs, Spartanburg, Greenville, and other places I do not remember as it was one hundred and fifty miles we had to go. We passed through Pickens, it was not a large place and I remember the court house more than anything else, we then stopped at a nice farm and bought the sweetest butter I ever ate. The woman asked where we were from, and when I told her she said she used to live there also. She asked if I knew the Guytons, and when I said I did she said that if I should go back again to tell them you saw me and that I have 13 children living. She told me her name but I have forgotten it long ago. On the way we stopped at Tocoee Falls and had dinner by them. We crossed two rivers, the Keowee and Tugaloo, the latter being the dividing line between SC and Georgia. Somewhere along our way we crossed a small brook and Bill Ferguson stopped to let the horses drink. Something frightened them and they started to run. I was walking up the hill ahead and as they came plunging along I caught the lines. Ferguson had fallen on the tongue and couldn't get up, and you can be sure that he was glad I stopped them when I did. GA-60 So we traveled on until we reached Mossy Creek, and there we met Eliza and the children. They were overjoyed at seeing us. I think it was a year later that Horatio Hennion and his partner Mr. Jones, bought the forge from Eliza and began making iron. The forge was right in front of our house. It was very pretty along the creek, it flowed into the Chattahoochee River. This is where I met your father, on the banks of sweet Mossy Creek. I was strolling along with Eliza and we met him and Young Davis. They stopped to ask Eliza about the forge, then came down again to make arrangements to buy it, and when these were completed they started making iron. Thus things went on until Horatio started coming across the creek pretty often. In about a year or a little more we were foolish enough to get married. Our first child, William Norcross, was born here, but after Horatio quit the iron business we moved to Mossy Creek Campground, called Leo, near Skitts Mountain, where he worked at his trade of making wagons. It was there our second child, Julian Wilson, was born, and in 1860 we moved to Gainsville. Horatio had all the work he could do there, and would have done well, but his partner cheated him I believe. Here our third son, Horace Victor, was born. In April 1861 the Civil War broke out, and as Horatio was a strong Union man, our troubles commenced. Montgomery, a friend of Horatio's, told him they were going to mob him and ride him on a rail, so he went back to Mossy Creek to my sisters, and sent for me in about two weeks. The balance of this has more to do with Horatio's evading the Confederates than anything else, so from this point on I will mention only highlights, and any relationships I run on to. Horatio hid out at a still house with other Boys, as they termed themselves. This was not far from their house and a pre arranged signal was for Margaret to call their dog Rolla if the Rebs came. This happened and when she called Rolla several times her son Bill told her that Rolla was there. The Rebs asked how many dogs they had and she said two, but they had detected that this was a signal, Ratio had split however and they never found him. She mentions a niece named Ann Jane, (who must have been a dau. of Eliza, Margaret's sister). She also says the house they lived in was the Brock house, and that when she would become lonesome she would sometimes cross the creek and stay at Mr. Brock's. (This Brock was probably a descendant of Thomas Brock Sr., who was the father of Nancy Jane Brock, who married William Jasper Ferguson, elder brother to John H., Hugh H., et al. I suspect it was Thomas Brock Jr., son of Thomas Brock Sr.). Margaret Jane had been baking a lot of Indian bread when the Rebs came. Horatio was going to NC with the "Boys", and this was to take with them. When the Rebs asked why she made so much bread, she said that it was to eat, so they ate it. GA-61 The Rebs threatened to take Margaret's baby Alice with them if she did not tell where Horatio was. Alice was about 13 months of age at the time and as Margaret notes that it was on 30 Jan 1863 when the Rebs came, you can compute her approximate date of birth from that. The Rebs did take Alice, and said they were going to drown her but she said she didn't believe that or she would have fought. They dropped her at Kim Staytons house, and he brought her back. (I think this is Kimsey Staton, brother of Tom Staton, who married Josephine Moore, she a dau. of Milton Moore and Mary Ann Ferguson, this Mary Ann a dau. of Hugh Ferguson and Mary Ann Higgins). Margaret states here that they moved into a nice house owned by Jake Ferguson, who was a Union man. Her mother lived with her there, but as Horatio was having so many problems with the Confederates he moved to NC, and was employed there in an iron forge. Due to this type of work he was exempt from conscription, and he came for Margaret with a team and wagon, moving them out at night. Margaret states this was the last time she saw her mother until she visited her in SC, this in Nov of 1874. (from this I think you can fix an approximate date for her death, this with data given earlier in this. The Jake Ferguson mentioned has to be Jacob V. Ferguson, son of Champion Ferguson, he a brother to Hugh Ferguson Sr. L.L.D.) Margaret now mentions a dau. Florence, but gives no additional information about her, other than to say she was a babe in arms. After the war they go by train to New Jersey, and while on the road to Morristown they meet Horatio's father. Margaret mentions a brother John, who married Anna. Horatio Hennion does mention leading a small group of men to free Bill O'Kelly from the log jail at Cleveland Ga. (This Bill O'Kelly was the father of Frank M. O'Kelly, who married Sarah Ann Manerva Ferguson, dau. of Champion and Rachel Ferguson.) GA-62 Habersham Co., Ga. Deed Book S, page 593 Instituted 17 May 1854, Recorded 23 Apr 1856. I James H. Sampson & I Thomas Brock Jr., do solemnly swear that this now presented contains the true last will and testament of the within named John J. Higgins deceased so far as I know or believe and that I will and truly execute the same, by paying first the debts and then the legacies contained in the said will as far as his goods and chattels will thereto extend and the law charge me and that I will make a true and perfect inventory of all such goods and chattels. Sampson and Thomas Brock Jr. the executors therein named and that Hugh Ferguson, Wm. Ferguson, Thos Brock Sr., Doris M. House, and John M. Dorsey, be and they are hereby appointed appraisers upon said estate. It is obvious that the will of John J. Higgins was never recorded, and that James H. Sampson and Thomas Brock Jr. presented this will for probate to the Court of Ordinary Aug term, 1855, this after the decease of John J. Higgins. GA-71 It should be noted that James H. Sampson married Louisa Brock, dau. of Thomas Brock Sr., that Hugh Ferguson married Mary Ann Higgins, and that the William Ferguson shown was a son of Hugh Ferguson and Mary Ann Higgins, and also that this William Ferguson married Nancy Jane Brock, dau. of Thomas and Jane Brock. While still unproven, a great amount of evidence indicates that Thomas Brock Sr. married Jane Higgins, and that this Jane Higgins, John J. Higgins, and Mary Ann Higgins, were brother and sisters, and appear to have been children of Henry Higgins. Will of John J. Higgins | In the name of God Amen State of Georgia | Habersham County | Know ye that I John J. Higgins of the state and county above written, being of weak body but of strong mind and memory, do give my body to the earth, do give my following property (viz) that is to say my earthly goods and chattels. 1st I give my lot of land number one hundred and twenty three, in the Second District of Habersham County, to my beloved wife Mary Higgins during lifetime or widowhood, also I give my sorrel mare, also I give two cows, two heifers, and two yearlings, also all the household and kitchen furniture in my dwelling house kitchen to remain my wife Mary's during widowhood or life time, also my home hogs I give my wife Mary during her life tome or widowhood. 2nd I give my daughter Claracy Caroline Higgins one cow and calf, one bed and furniture belonging therunto, also one set plates, also one set knives and forks, also one set cups and saucers, also one set spoons, to have and to hold from my decease. Be it known that Claracy Caroline, my daughter to have support on my plantation with her mother while she continues as she is or single. Also the balance of my land and property to be sold and my debts first paid, the balance to be equally divided, share and share, with all the legatees, to be sold after my decease at a convenient time. But I give my son Newton Higgins my land number one hundred and twenty three in the above named county at my wife's decease or intermarriage, the balance of household and kitchen furniture, the sorrel mare, cows, heifers and yearlings and hogs, to be sold and equally divided between the legatees, at my wifes decease or inter marriage. Sutton Ordy Note in the following administration that Jennings Hulsey is shown as an heir, Jennings Hulsey married Emeline Higgins on 1 Apr 1847, Habersham Co., Ga., Emaline a dau. of John J. and Mary Higgins, therefore it appears that Emaline had died prior to this estate administration. GA-73 Estate Administration of John J. Higgins, by Executors James H. Sampson and Thomas Brock Jr. Administration of the estate began in 1855, this following the inventory made 6 Sept. 1855, by James H. Sampson and Thomas Brock Jr. There is nothing remarkable about the inventory, it contains the items usually seen in an inventory. It does show a book case and two shelves of books so apparently John J. Higgins was literate. The inventory also includes 1 lot of land No. 124, 2nd Dist. of Habersham, this valued at $200.00. 83 1/3 acres in the 2nd Dist. of Habersham, valued at $150.00, and 11 acres No. 145 in the second Dist. of Habersham, valued at $2.50. Over all John J. Higgins appears to have been comfortable for those years. John Anderson, B.M. Grambling, W.A. Hunt, and Thomas Amburn?, shown as collecting various amounts totaling $17.50. John Anderson later pays $13.55, and Newton Higgins $10.00. After the debts were settled, the total amount remaining in the estate was $130.38. The land was then sold, bringing $390.00, or a total of $520.38. From this sum the heirs were paid, this in the following manner: Eli and Elizabeth Cox $22.50 George and Anna Brock $22.50 John Higgins $22.50 Jennnings Hulsey $22.50 A.J. and Jane Ferguson $22.50 Clarissa J. House $1.88 Helen Bowen $5.00 Andrew Dorsey (on note) $30.70 John Duckett $170.77 Sub Total $348.57 Sale of insolvent notes .45 This same subtracted from $520.38 left a balance in the estate of $172.46, no mention of what happened to it. Recorded on 15 Aug 1857. GA-74 Thomas Brock Jr., one of the executors of the estate of John J. Higgins, was a son of Thomas and Jane Brock Sr. James H. Sampson, he the other executor, married a dau. of Thomas & Jane Brock Sr. Undocumented information given to me regarding Thomas and Jane Brock, states that her maiden name was Higgins. Andrew J. Ferguson married Jane Higgins, dau. of John J. Higgins, and George Brock married Anna Higgins, therefore it would appear that those getting $22.50 from the estate of John J. Higgins were his direct heirs. The fact that Thomas Brock Jr. and James H. Sampson were the executors of the estate of John J. Higgins would indicate some relationship existed, and it would appear that this would be through Jane, wife of Thomas Brock Sr. In the 1850 census of Habersham Co., Ga., this Jane is seen as being 69 years of age, born SC. Eli Cox was a son of William Cox, and brother to Carey Cox. Considering the time period of the foregoing administration, the John Duckett shown would be the John Duckett who was a son of Jacob and Amy Duckett. This John Duckett went to the Calif. gold fields with his brother Dolphus Duckett in Nov of 1851, Dolphus returned with about $3,000.00, and I think we can presume that John Duckett also returned with some amount. perhaps he loaned his father in law some, and that's what we see here. Belfield, Elijah and Champion, all sons of William and Juda (Wood) Ferguson, were all living after the date of death for Juda, however those who had formerly resided Ga. were either deceased by this time, or had moved from this area. Champion Ferguson is a proven son of William and Juda, and he died in 1881. Elijah Ferguson died in 1875. C. ______________________________ GA-91 Deposition. 24 Jan 1868 State of Georgia | County of Habersham | SS On this 24th day of January A.D. one thousand eight hundred and sixty eight, personally appeared before me , James E. Griggs, Clerk of the Superior Court in said State and County, the same being a court of record, Andrew J. Ferguson, aged 48 years, a resident of said county and State, and a son and only surviving heir of Judah Ferguson, who being duly sworn according to law, declares that she is the identical Judah Ferguson who was a United States pensioner on the roll of the Savannah Georgia Agency, as the widow of William Ferguson, Revolutionary Soldier and whose pension certificate was returned in in a former application to the Third Auditor's office of the Treasury Department for what is due in this case. That she resided since the first day of January A.D. 1861 in the county of Habersham, state of Georgia, to the 27th day of March, 1862 which was the day of her death. That she was loyal to the Government of the United States during that time and was too old to follow any business for a support in life and that her pension was last paid on the 4th day of March, 1860 and that he, the applicant has not borne arms against the Government of the United States or in any manner encouraged the rebels or manifested a sympathy with their cause and as evidence of this he left home and went to the Army of the United States and joined a company, but said company was never mustered into service before the surrender. This application is made for the purpose of securing a restoration of her name to the pension rolls and of obtaining a new pension certificate, such as she may be entitled to under existing laws, reference being made to the evidence heretofore filed in the Pension Office to substitute her original claim. J.A. Bird Drury McMillion ______________________________ GA-92 Letter by Thomas J. Hughes. 4 Feb 1868 Clarksville, Georgia, February 4th, 1868 Sir: I herewith send the declaration of Andrew J. Ferguson, claiming restoration of Judah Ferguson, desceased, (his mother) to her pension and for further satisfactory evidence that he did go to the Army of the United States during the rebellion. I send his amnesty oath that he took in Tennessee when he left home. I would thank you if it could be possible to act on this case and return it in time to draw the money the 4th of next March. Hughes. 27 May 1868 Clarksville, Georgia May 27th, 1868 Sir: The case of Andrew J. Ferguson applying for what was due his mother, Judah Ferguson, widow of Rev. soldier, at her death, seems to lie over a long time without any action being had on it, and I can't see any good reason for it. She was evidently a pensioner and he was (two or three words indecipherable) man in the late rebellion in the south and went into the State of Tennessee from Georgia and identified himself with the United States Army and has made proof of that fact, and I don't see why the claim is not allowed. He urges me to solicit its allowance as soon as possible and I hope it will be done. Yours, &c. Tho. J. Hughes Jos. H. Griggs, Clerk of the Superior Court of said County and State, James S. Davis, who being duly sworn according to law, deposeth and saith on oath, that he is the grandson of Judah Furgason, deceased; that he was at her house on the day of her death. She died on the 27th day of February, 1862, and was buried the day following. He further swears that she was the widow of William Fugason a revolutionary soldier and was in receipt of a pension as his survivor at the time of her death. James S. Davis Sworn to and subscribed before me this 8th day of September, 1868, and I hereby certify that the above named affiant may be relied on for truth and honesty and that I am not in the prosecution of this claim. See the Deposition for Pension made by William Ferguson under Cumberland Co., Ky. in this book. 2. See the Marriage Bond of William and Judah (Wood) Ferguson under Greene Co., Tenn. in this book. 3. Note: To clarify for some. Pensions going to those residing in southern states were terminated during the period of the Civil War and an application had to be initiated before these pensions were resumed. In this particular case Andrew is attempting to get the money that would have been due his mother Judah from the date of pension termination, until her death in Feb. of 1862. Union loyalties were an issue in this and it was apparently for this reason that Andrew attempted to distance himself from the Confederacy. Some conjecture exists as to Champion, son of William and Juda Ferguson, being a Confederate soldier. See the deposition made by Champion Ferguson in Adair Co., Ky. on behalf of his sister in law, Selina (Duckett) Ferguson, widow of Edward Ferguson. Also note that Champion's son Josiah Messer was a Union soldier, see this under Calif. However years ago I was sent a page from a book, this page containing approximatly 25 photos of the officers of a Confederate General who compiled photos of his officers, these all from Ga., and in these pictures is one Champion Ferguson shown in the Confederate uniform of a Colonel. GA-94 Note also that John Franklin Ferguson, nephew of Champion Ferguson, refered to Champion as Colonel Champion. This reported by Elijah Chastain, a grandson of John Franklin Ferguson. See in Meigs Co., Tenn. data. Also note that the only other Champion Ferguson that I have found that would fit the age parameter for this is the Champ Ferguson who was a son of William R. Ferguson and Zilpha Huff, and the Capt. of Confederate Cavalry. Pictures of this Champ Ferguson and the picture shown on the mentioned page of pictures, show these Champions to be different people however. The page of pictures in question was lost during a tornado, and I have been unable to find the book from which it was taken. The page was sent to me by Wilma Fordyce, who at the time resided in Los Vegas, Nevada, so this book must reside in the library there. I think there may be this possibility, Champion accepted the commission in the Confederate Army, this more as a delaying tactic than anything, then he escaped to Tenn. as soon as it became possible. Note that Champion's brother Edward refused a Captaincy in the Confederate Army. GA-95
